Abstract

In order to discuss the canonical right to remuneration and support for clerical who have become unsuitable for ecclesiastical office, I shall do this in four chapters. in the first chapter of this research I set out to identify what the clerical state entails, how it is acquired and how it could be lost. I shall also discuss the concept of incardination and the rights and obligations that arise from the clerical state and incardination. The second chapter based on ecclesiastical office, deals with the canonical description and requirements for appointment to an ecclesiastical office. Who can acquire an ecclesiastical office and what rights are those who hold an ecclesiastical office. I also looked at how this office could be lost. In chapter three, I discussed the remuneration and support of incardinated clerics. In doing so, I make an attempt to clarify the terms remuneration and support as it applies to clerics in general and to clerics without an ecclesiastical office or those unsuitable for appointment to an office in particular. Here, I looked at the concept of 'Remuneratio ex incardinatione vis a vis Remuneratio ex Officio', seeking to identify the different types of remuneration which a cleric can claim according to the law. In discussing these concepts, I sought to identify which of the concepts was more fundamental to the cleric and if the concept of remuneratio ex incardinatione is retained when a cleric hold no ecclesiastical office. Chapter four dealt with nature of being unsuitable for an ecclesiastical office. Here, I treated the different ways by which a cleric could become unsuitable for an office and the level of support available to the cleric. In doing so, I looked at the concept of remuneratio ex incardinatione and the rights of the cleric as an incardinated cleric of the diocese. If the rights of the incardinated cleric to remuneration remains while he is in the clerical state, what level of support is available to him if the clerical state is lost, and for how long is this support to be provided? In the last part of this research, I concluded by revisiting the main research questions in the introduction, reviewing how the various chapters have sought to give an answer to these questions. Hereafter, I made some personal reflections.
